    FLORIDA SENATE ALIMONY REFORM BILL SB 718 PASSES FLORIDA HOUSE - The Taylor Law Office

    Everyone seems to be focused on the alimony (spousal support changes) but it is the presumed equal shared parenting that catches my eye. I can't believe that Florida could be so progressive.

    If they can get a law like that passed in Florida, it should be do-able in Ontario!

    The linked article of course sees it as a bad thing. I have no idea how presumed equal shared parenting can lead to increased litigation. To me, the opposite would be true. Once parents get it through their head that divorce will involve sharing, and will not involve "victory", I imagine most will be much more willing to work things out.

    Personally, I think this portion of Senate Bill SB 718 will create more child custody litigation because their are numerous circumstances where equal time-sharing is not in the best interests of child, even when both parents are good people. When it is not in the child(ren)’s best to have 50/50 time-sharing with both parents, Senate Bill SB 718 will make it necessary to heavily litigate child custody issues to meet the clear and convincing burden of evidence.
    This lawyer is too close to the situation to see it clearly. I am sure that anyone who walks into his office will be heavily pressured by him to litigate. If the changes are properly explained to divorcing couples, shared parenting can approached as a positive solution. The only time shared parenting is NOT in the child's best interest is when there is clear and compelling evidence available. If there is no evidence, there is nothing to litigate. If there is evidence, then a responsible attorney will advise their client to work out a settlement.
    Excellent Job Lobbying By Florida Alimony Reform
    Florida Alimony Reform (“FAR”), the group spearheading Florida alimony reform, did an excellent job lobbying the Legislature and getting the message of alimony reform out to the public. It appears that FAR’s hard work is about to pay off. As a family law practitioner, I will be working through the result of the changes for years to come.
    I'm not surprised this was pushed through in Florida. The fact that the state legislature responds to heavy lobbying is also why extreme positions are passed on issues like same-sex marriage and self-defense.

      I think that Florida may be surprisingly progressive b/c of Gary Neuman: The Official Website of Author M. Gary Neuman (He is based in Florida btw.)

      I reviewed all his advice on children and divorce before and after I separated from by stbx.

      I first saw this guy on Oprah (yup!). It was heartwrenching: The Children Who Imprinted on Oprah's Heart - Where Are They Now? - Oprah Winfrey Network - YouTube

      Believe it or not... this is how I discovered it wasn't about men vs. women when it came to custody. It was healthy vs. unhealthy. I would guess that the majority of parents involved in divorce are both healthy enough to parent well enough. So 50:50 as the starting point is not crazy.

      Unfortunately, that is not the case for my situation and, yes, a lawyer is making money at my expense.
