    I have a question I'm sure has been posted here many times before but after looking through 30 pages I'm bug eyed.

    My agreement was made shortly after the Guidelines came into effect. It states "The Husband shall pay in support of the children to the Wife the sum of $$$ per month, in accordance to the Federal Child Support Guideline." It doesn't say that we are to exchange financials yearly.

    Now reading the Income_Disclosure_Handout from March 2010 it states:
    The new requirement also applies to existing child support orders, but not to existing agreements. If both parties to an existing support order agree, they can sign a written agreement so that these obligations do not apply.

    First question: every thread I read I see posters say "if your agreement states Financials to be disclosed yearly". Doesn't the Income Disclosure guidelines make that irrelevant?

    2nd question: What is the difference between an existing child support order and an existing agreement??

    3rd question: do you request based on date of Separation or Divorce decree? (Separation agreement survived Divorce)

    4th question: how do you word the request? I don't want to remind him of his obligation - the fact that I'm requesting an updated NOA is going to piss him off, no point rubbing him further.

    I've been putting this off for a few years as I'm expecting this is not going to go well. The difference between what I'm now receiving and low balling his income is over $500/m which would absolutely help in the day to day running of a house with teenagers. (for those wondering we've never shared s7 - I cover everything)

      Redundancy in favour of disclosure is beneficial because it makes the case for obtaining it easier. Also see #3.

      2nd question: What is the difference between an existing child support order and an existing agreement??
      An Order is made by the Courts. An Agreement is made between the parties. The agreement may be enforced as a court order if filed with the court but this does not make it a court Order.

      Enforcement of agreements is easier, if you don't have an Order stating yearly disclosure.

      Simple is good. "Our agreement says child support as per Guidelines. Please send me your NAO so we can calculate how much support is."
