  • Procedure: how do I fail my divorce papers at court

    I have somehow completed all the forms for simple divorce, attached our marriage certificate with proper translation, and now I need to actually deliver this whole package to the court.

    How do I do it in Ontario?
    Do I just go to Supreme Court in my municipality and ask them?
    Do I need to make copies of documents? How many?
    How will my ex wife be informed?

    Please advice.

    Hi Rios this link will help you with what you need to know. Mine was uncontested and simple. I also did it myself and it cost me approx $500.00 from start to finish.

      For a simple divorce, your initial filing fee in Ontario will be $167.00 (157 application fee + 10 for clearance certificate).

      Go to the local court house in your region and ask someone where to find the "Family Counter". That is where you will file your new application.

      Bring a few copies of the application to be issued. That means the court will stamp it. Your ex will be notified when someone (not you; but you can ask/pay a friend or neighbour if they are over 18) shows her the original and gives her a copy of the application. You will then file the issued application with an affidavit of service, put together in a continuing record.

        OK, so I went as you said to family desk where they made an appointment for me with court clerk in Filling Office and I filled papers there. I made 2 copies of an original papers and included marriage certificate. I also filled up some sort of pink papers being I think divorce registration?
        Original papers and marriage certificate were taken by the clerk, and my copies were signed by her and numbered with my case number. I do not have an original anymore.

        Now, I understand my friend has to hand one set of copies to my ex.
        Once he does, he has to fill up paper called affidavit and what I do with this affidavit?

          The affidavit will be filed, with a sealed original, at the court filing counter.

            OK, thank you. In that case I have to take my friend with my to the court and make the appointment once again to my clerk. I understand clerk will hand us proper form to sign.
