    Currently my ex's CS payments is going through FRO, and it was 3 months behind in arrears, and he got "caught" up and is now "two months" behind in arrears.

    He has a WSIB Cheque every month, and I had requested FRO to garnish his wages, but I have been told that unless he is 3 months behind, they will not do anything and will not put through my request for garnishment.
    Their reasoning is that if it went through garnishment from WSIB Cheque, I would have to wait 35 days before I see a cheque from them. I did say to FRO that at least that way I know it WILL BE coming in 35 days rather than ex trying to control when he will send the cheque to FRO.

    They have asked him to "voluntarily" have a monthly withdrawal from his account - but OF COURSE he doesnt want to do that.

    Is there any other recourse for me ?
    I contacted the Ombudsman of Ontario, but they are giving me the same line as FRO.

    The ex has recently taken off his "employer" source and is an "independent contractor" (Construction), so I can't go and garnish it off from his wages.

    He owes me for 2 years of Section 7 expenses that he has yet to help pay for........That's bad enough, but I need to get the monthly CS for our daughter. Any ideas on how to deal with this would be appreciated.

    If you aren't getting CS then next month it will be 3 months and you have your answer. If he is paying now, but is 2 months behind, he will stay 2 months behind, but you ARE getting CS now.

    The FROs rule is their rule, you won't change that. You can go to court to litigate for 2 months CS and the outstanding section 7, or you can live with the current situation.
