So, I am officially a self repper as of today. My ex's lawyer emailed me today and requested another appraisal of the home. I paid for one in October of 2010 myself (which i felt was high) and now they are requesting to have another one done and me pay half. Obviously my wife did not like what the house was appraised at. Does this seem fair? My question to him was "which appraisal will be used? will it be an average? AND will the same apply if her appraiser appraises it lower? any thoughts?

Provide the documentation of the appraisal you had done and the bill to show you paid for it. Unfortunately, enough time has passed that you'd need another one done to get a current valuation.
Why wasn't anything done after your appraisal? If it was due to her refusal to do move things forward, provide the dates of the offers you'd made and state that since you'd made several offers and she refused that, her actions have incurred these costs and she should be responsible for them.
If there is more than one appraisal they will likely take the median of the two.

Agree to the request but, turn it around a bit.
1. Request that they retain their own appraiser to conduct the valuation and that the valuation date be set to the date already agreed upon as the date of separation.
2. They pay for their appraisal themselves. You will make the home available on a specific date for the appraiser. (Propose dates in your response.)
3. You retain your own and have a appraisal done yourself (notify them of this) and agree to the date of separation and that your valuation will be done to that date.
4. Agree that both parties are to advise the appraisers involved that they are to submit their reports to both parties upon completion directly.
5. Mark the communication WITH PREJUDICE.
6. Real appraisers who are certified only. Not a real estate agent.
They bear their cost for their valuation and you bear your cost. There can only be a 10% difference between the appraisals... This should be done by a certified appraiser (both valuations against the date of separation).
