OMG my lawyer accepted another position...

  • OMG my lawyer accepted another position...

    OMG my lawyer just contacted me and informed me that he has accepted a position with a legal clinic and that as of March 16th he is done his current practice. I go back to court March 5th, which he said he will attend with me... but then what!!!! he said if things go further then he will pass my case along to another lawyer... How will another lawyer know my case like my current lawyer does.. I feel like I could be sick!
    Has anyone changed or been in a position to have to change lawyers towards the end of their "court process" ??
    I just pray it is over with March 5th so that I do not have to go through another lawyer.

    I will check into the Law Society code of conduct on this one. Check up "reasonable notice" and see what it says in the mean time.

      Hi nerverending:

      I am same way as you, would like to keep same lawyer as long as they are good . I have same lawyer from 2006, and my EX had changed atleast 6 lawyer during that time (1 on side in US and 5 in Canada one at a time). He is still talking to hire another lawyer as he does not want to pay CS. I hope you get a better one, or may in the same firm.

        so my situation is this.... I return to court Mar 5th, my ex is suppose to have his "stuff" filed by March 1. His history is waiting until the very last second to file.. If he files "stuff" then we go into a trial, if he does not file anything then we go through with March 5th date. my concern for switching lawyers at this point is... I can't afford anther retainer fee... I had to save up just to get the first retainer for the lawyer I have now. He has a private practice and is leaving for a Legal Clinic, and wont be doing Family Law there... I am praying that March 5 comes and this whole thing gets finished so that I dont have continue with courts and lawyers.
        I am truly frustrted.. 2 steps forward 5 steps back...

          I would suggest to ask your existing lawyer to help you as you have retained him with good faith. See if he is ready to pass your case to other lawyer with in the same firm. Then you do not need to pay other retainer as they can transfer previous amount from trust. This is only possible if he is a partner with others. If he is by himself and closing his practice, then you may need to find yours. Sometime, it is hard to find a good lawyer. Let me know if you want me to refer you in this situation.

            thanks Singlemom - sucks to be me.. he is a private practicing lawyer! Also how ironic - the lawyer he thinks I may be a good match with was my ex's duty counsel lawyer the last time I attended court un-represented!!!! So she is a write off... I am truly praying to a higher power. If you have a referal please let me know (it would be for Guelph court)...

              I know exactly the stress you feel. My lawyer quit on me, just before we had to file Trial Records, Evidence, now I have no lawyer and am beyond stressed. I think I may adjourn my case till I'm dead. This whole system is BS. How these scum lawyers can play with people's lives is bloody corrupt. And the court system is a JOKE. I'm interviewing lawyers, but no one wants my case this late in the game. Out $50,000 would have spent another $50,000 last year, but self repp'd. NOw Trial....figure on another $50,000. We're not even fighting for that much money, but this f'd up Train is now outta contro. The system bankrupts hard working people and destroys their lives!
