  • Paid her student loans but got stuck with mine

    Hi,

We are now separated and have been so for three months. While married, we paid off her student loans from our shared bank account six months after marriage. During our six-year marriage, we paid my student loan on a monthly basis from our shared account until she left the house. I'm now paying my loans without any help from her although we had paid her loan while together.

The loan is under my name, however, I feel that she is not being fair in honouring our intention to pay off my student loan TOGETHER given that we had paid off hers. Having to have paid portions of my loan for a period of six years is an indication that we had had an understanding to pay it off...

Where do I go from here and what do I do?

    Thank you in advance!

It's accounted for in Equalization I believe. Just make sure all the numbers for both your loans are accounted for.

You provide a snapshot of your finances when you got married, and at the date of separation, and balance it out.

Without more specifics, I think it will work out that she will owe you back for half of her student debt paid off during the marriage. Of course, you will also owe her half of what you paid off together of your loans. If it wasn't fair, half of the difference should be owing to you.
