Dear Stephen:

Thank-you for all the efforts on bringing this crime forward to the courts and bringing forward jurisprudence and sentencing on the matter of grandparent assisted child abduction.

This criminal conviction and sentencing brings to light the criminal nature of parental abduction and although many, as the justice noted in oral statements, may not think the sentence fits the crime, the cold hard fact is that a conviction was made and a sentence was handed down.

What I hope you, and the others within your organization realize is that this case law is now jurisprudence for other parents who's children have been abducted, with the assistance of grandparents, their "friends", lawyers and possibly even "shelters" whom attempt to use false allegations of abuse as the justification to their actions.

I look forward to the posting of the transcripts to review in full regarding the sentencing of the criminal in this matter.

I will provide some insight cross referenced to recent case law that has evolved in family law matters shortly with regards to the Toronto Star article.

Furthermore, is it possible for you to share the name of the Crown Counsel who made this all possible? I would like to write a personal thank-you and post it to this forum to counsel for their incredible efforts on bringing forward much needed jurisprudence on this matter.

Good Luck!
Tayken

Mom's quote, from the Star article, regarding her Dad's sentence:
“That doesn’t sound very fair does it?”

...says the child abductor. Wow.

Sorry, my response to the thread is probably not helpful. I apologize. I just found it shocking.

Dad2bandm:

Actually, your comment is bang-on and the identification of the statement as a completely and possibly narcissistic statement by the now convicted abducting mother in the matter is well placed.

What the courts need to recognize, as you have identified, and no doubt thousands of people reading that article today, is the complete lack of understanding, arrogance and self centred statements that possibly Axis II disordered people make.

The statement made by the criminal abductor in this matter speaks volumes to the lack of empathy, understanding and self realization that often Axis II disordered people clinically lack.

Your observation, is just one of the thousands of similar observations to that statement people are making today. Also, the possible transference demonstrated in the criminal abducting grandfather and similar patterns of possibly Axis II disordered driven "feelings" as expressed by the defence counsel of his criminal client are similar.

I again urge Mr. Watkins to reach out to the clinical community, namely:

Mr. William Eddy (High Conflict Institute)
Randi Kregger (BPD Central and author of Stop Walking on Eggshells)
Dr. Tara Palmatier (shrink4men.com)
Dr. Christine Ann Lawson (Understanding the Borderliine Mother)

I have no doubt that between Mr. Watkins' matrimonial file and these criminal proceedings, discovery questioning transcripts, police incident reports, custody evaluations (OCL/Section 30), CAS reports, medical documentation from the children's Canadian medical records, and upon court order (should the crown be able to do so) a full extraction of the now convicted mother and grandfather's medical records that enough "evidence based medicine" exists to demonstrate a clear pattern of behaviour and possibly a forensic diagnosis of the criminal abducting mother and grandfather.

Should Mr. Watkins desire and require assistance in this matter on how to begin the process of putting together the forensic evidence for his efforts before the Polish courts, it can be done.

Good Luck!

True... I just meant, I was probably not being helpful, saying what everybody else already seems to see or think, with that statement. Stating the obvious, you know.

I find Dr. Tara Palmatier's work/articles, to be spot on.

Actually, if people in society called out the possibly highly conflicted on these passive agressive statements like you have done, it would bring much needed attention to the emotional issues that abducting parents expose in these basic statements.

Other common statements by abducting parents that may exhibit behaviour patterns of Axis II disorders (Cluster B & C):

"I didn't know what else to do."
"I felt unsafe."
"These are my children."
"I am their mother/father."
"It's all his/her fault."

Often abducting parents, as articulated in case law, and repeated over-and-over by justices:

1. Abducting parents often have help from family, "friends" and even counsel.

2. Abducting parents are unable to put the "best interests" of the children before their own litigation strategy and "feelings". (e.g. trying to leverage an emergency ex-parte motion to create a false "status quo" is one of the tell-all signs of this pattern of behaviour)

3. Abducting parents often try to justify false allegations of child endangerment/abuse and "domestic violence".

4. Abducting parents are often unable to let go of their "feelings" and/or "beliefs" about the other parent, even after the court orders joint custody, equal access, or even sole custody to the other parent. They continue to try to "justify" their "beliefs" and "feelings" by gathering negative advocates that support their projections and false truths about the other parent.

What these abductors don't realize is that the court does not take children away from parents. Their conduct, continued false "beliefs" and patterns of consistent and transparent behaviour is what eventually leads to the courts having to remove their right to make custodial decisions for the children, reduces their access to the children and in the most extreme circumstances, requires that their access to the children be supervised.

Should anyone reading this message have abducted their children in contravention of section 283.(1) and/or 282.(1) read this message thread, you have it within yourself to expose those who advised you to do so, report these people to the proper authorities. There is always an opportunity to do the right thing, follow good advice and expose the common tactics that negative advocate solicitors sell as "snake oil" to emotionally distraught parents who are anxious. If you have been a victim of false instruction by a barrister and solicitor the Law Society of Upper Canada can assist you in bringing much needed attention to the common and transparent "tactics" of these negative advocate solicitors.

Good Luck!
Tayken

November 20, 2012 Launch Day - Stephen Watkins and a group of Canadian Parents launched a new Canadian organization called the iCHAPEAU Association and are proposing a new Federal / Provincial Canadian Law called the: iCHAPEAU Act.
VIDEO: iCHAPEAU Association - Stephen Watkins helps launch iCHAPEAU to help STOP Parental Child Abductions - YouTube

Affected Canadian parents are working together to help STOP Parental Child abductions by campaigning for the proposal of Canada’s iCHAPEAU Act to provide better tools to Family Courts to detect and PREVENT child abduction cases along with giving our Canadian government more solutions when dealing with international child abductions when Canadian children have been retained or harboured by foreign nations and ordered NOT to be retuned through the non-compliances of international treaties already signed with the country of Canada.

The November 20th Launch for the iCHAPEAU Association date was also significant as it was also the United Nations Universal Children's Day recognized World-wide and the day Canada marks the day in which the Assembly adopted the "Declaration of the Rights of the Child", in 1959, and the "Convention on the Rights of the Child", in 1989.

There were 4 Victim Impact Statements read into Court on November 20th, including moving testimony of that of a 14-year old step-sister of the abducted two boys which was so powerful that it reduced grown men to tears in the gallery. In the final Victim Impact Statement made by Stephen Watkins, he mentioned the creation of this new Parents Association in Canada along with acknowledging the presence other parents who are dealing with similar cases within the court room.

The Canadian parents in attendance:

- STEPHEN WATKINS – Missing / Abducted: Alexander & Christopher Watkins

- CESAR CAETANO – Abducted: Alice Caetano
Alice Caetano | Canada's iCHAPEAU Law

- GRZEGORZ NOWACKI – Aleksander Nowacki

- BRUCE GHERBETTI – Rion Suzuki, Lauren & Julia Gherbetti
(Attended in spirit as he is currently in Japan)
Rion Suzuki, Lauren & Julia Gherbetti | Canada's iCHAPEAU Law

- Other Non-Public iCHAPEAU Association Members were also in attendance

These public cases represent 7 abducted Canadian children who have been illegally kidnapped from Canada and harboured by other non-compliant nations such as Poland, Brazil and Japan.

There were other affected parents in attendance whose cases are not publicly known as well. In total, the iCHAPAEU Associations public and non-public cases represents a total of 15 abducted children to date and more parents are starting to contact the iCHAPEAU Association to share their cases.

The iCHAPEAU Association will have all their members’ cases publicly shown to bring more attention to their cases along with the issues of Parental Child Abductions which affects 83% of all child abductions from Canada.

The Canadian Press 12/4/2012 interview with Stephen Watkins RAW VIDEO about International Parental Child Abduction of his two Canadian sons to Poland, iCHAPEAU Association and the proposed Canada's iCHAPEAU Law Act and Canadian / Polish Grandfather gets house arrest for helping daughter abduct her boys to Poland.

On December 4, 2012 the sentencing of the Grandfather found guilty on August 23, 2012 in aiding Canadian Abduction in the "Watkins Missing Children" case was announced in the Newmarket Courts after over two and a half years. (THE CANADIAN PRESS STORY LINK BELOW) It was originally scheduled on November 20, 2012 but the Honorable Justice J.F. KENKEL decided to deliberate on this decision as it has been confirmed by the Newmarket Ministry of the Attorney General Crown, who is prosecuting this case and by other sources, that this is the FIRST PRECEDENT setting conviction in Canadian history of a family member being found guilty of assisting in a Parental Child Abduction under the Canadian Criminal Code, section 282 (1) offence. (COURT TRANSCRIPTS DOWNLOADABLE BELOW)

iCHAPEAU Association - On November 20th, a group of parents whose children have also been nationally / internationally abducted from Canada to different countries attended the Newmarket Courts in Ontario to hear the criminal sentencing of TEDEUSZ (Ted) USTASZEWSKI, a family member who assisted in the Parental Child Abduction of two Canadian boys, Alexander & Christopher Watkins, who the country of Poland has refused to return home to Canada. Their father, Stephen Watkins, is still fighting the Polish Courts to have is sons returned home even though he had sole custody prior to their abduction and the abducting non-custodial mother has had her parental rights "limited" by the Polish Courts due to child protection concerns brought by the boys Polish school.

Using the Newmarket Courts as a background to the event launch and on its particular sentencing day of the accused, the group of Canadian parents wanted to help drive the point to our elected Canadian officials that a crime has been committed, to help support all provincial court jurisdictions and police agencies across Canada and to send a clear message to other countries that Parental Child Abductions is a CRIME IN CANADA covered in the Canadian Criminal Code. It is also covered by multiple treaties including the Hague Convention on the Civil Aspects of International Child Abduction and the UN's Convention of the Rights of the Child (UNCRC).

This group of parents has launched a new Canadian organization called the iCHAPEAU Association and are proposing new Federal / Provincial Canadian Law called: Canada's iCHAPEAU Act

The " iCHAPEAU " stands for the " International Child Harbouring & Abduction Prevention Enforcement Act Under-Law "

Canadian parents are working together to help STOP Parental Child abductions by proposing new laws through Canada's iCHAPEAU Act to provide better tools to Family Courts to detect and PREVENT child abduction cases along with giving our Canadian government more solutions when dealing with international child abductions when Canadian children have been retained or harboured by foreign nations and ordered NOT to be retuned through the non-compliances of international treaties signed with Canada.

The iCHAPEAU Association will have members' cases publicly shown to bring more attention along with raising awareness of Parental Child Abductions which affects 83%* of all child abductions from Canada.
