Question new and looking for some advice on commonlaw seperations!!!

Was in relationship for 9 yrs. we have 3 children. We originally started out in an apartment that was rented by me. When i was pregnant with first child his family gave us a gift of a down payment on a home. The home never had my name on it. But i was responsible for all the bills, utilities, maintenance and up keep finacially. That house was sold and we purchased a second home again my name never went on it but the finaciall payout for bills and everything else fell on me while he sat back and just made mortgage payments. do I have any claim in the home after 9 yrs and we are seperating???

Yes you do.... in a best case scenario the house will be sold, all debts paid, and the remained will be split 50/50. Or one of you will buy the other out...Same as if you were married.

Check out the section of the forum on common law replationships.

Good luck

Tammy i do not want to get you angry but you need to prove on paper your contribution. If the house is in his name you may have a hard time. This is not a 50/50 split in common law but with 3 children that I assume are his children also you may have a chance. I recommend to go see a lawyer right away. Check the link below has lots of information, there is a file "all you should know about family law"

Thanks so much!! And not angry at all, my mom use to say I was anal about filing things and keeping old bills and paperwork forever!! thank god that didnt deter me from still doing it, as I now have file folds filled with bills, all in my name and all showing paid, along with copies of my online banking and payments!!!!!!!!! I also have a meeting on the 23 with a lawyer!! Thanks so much!!!!

Remember with children the court may want them to stay at this house even if that is his house. But do not set your hope on that. The children always come first.
