finally seperated
Hello
New on this forum, I would like to get some advise on how to proceed. We have been married for 13 years, decided to seperate last summer, and to file for divorce. But only in April of this year did I decide to move out, to get the ball rolling, as this room-mate living situation could have been going on and on for ever. We had been living under the same roof for 3 years. I live now with my son. My husband works from home so his moving out was not a good option for him.
To keep costs down, we think mediation or cooperative praxis is the way to go. However I have my doubts that we will find a commum ground as he has a lot to lose (a house, 200 acre property with cottages, a boat, a familly cottage). Personally I came to Canada with nothing to marry him! So nothing that I brought into the marriage.
I am now looking for a lawyer, as I understand that eventhough we choose mediation to settle things and prepare a separation agreement, the mediator will not replace the lawyer and each of us needs his own lawyer who will check the legallity of the agreement. Am I right?
If we go for cooperative praxis, do we need extra lawyers to finalize the divorce or not? Or are the lawyers involved in the process finalizing the case, or if no agreement can be reached, can litigate? These are my questios to start with.
I really have trouble finding a lawyer. How did you do it?
Thanks for your precious help. (Lakomka)
