hello all, i am new here and i have a few questions i was wondering if anybody can help me with.
i am in a common law relationship. i owned my own house and sold it to buy a new house with my partner, i put 76k in for the downpayment and she put in like 10k, the was about a year and a half ago, it is in both our names. i am not happy being in a controling relationship and want to end it, i cant live my life being bossed around 24 hours a day, for which socks i shoul wear to how i should shave my pubic area, how to cook, how to do laundry, how and when to walk the dog, constant yelling and screaming about it, slamming every door in the house all the time, these are all things i have done my whole life with no problems. she refuses to leave or let me pay her out. so my questions are: # 1, how do i start the seperation legaly, do i go down to the court house and file for seperation? # 2, once i move out and she stays do i have to continue to pay the mortage untill the house sells? # 3, do i need a laywer to do this and go into debt? this is gonna be ugly and i really need help to get my life back, please help me as i have never felt so trapped in my life. thanks in advance, paul calgary |

Best advice is to get a lawyer... if there are no children it is basically an equalization thing. DO NOT move out of the house until things are settled. It may be hard, and others here will have better advice on how to do this, but do not remove yourself form the home until you seek legal advice.

Agreed with Berner and Angie. Do not move ! Close ALL joint accounts, lines of credits, credit cards immediately.

My advice is to first seek some counselling for yourself. Make use of your employers EAP program.
You will need to be mentally fit, or at least have some support in place, in order to navigate through the legal system. Your head is in a bad place and you need to sort through the emotional baggage. The law doesn't care about emotion, the law is based on facts. You live in Alberta and some of the division of property is handled different than other provinces. You will need some legal advice for this. As a starting point, I would recommend looking in the phone book, (Telus on line), and find some Calgary lawyers web sites in order for you to obtain some basic knowledge of your rights. Then make a list of questions you want to ask a lawyer, or ask here. |
