Recently my ex common laws son moved back to the house to save some $ and didnt have anywhere to go, one of my major concerns was pot in the home, she smokes and now he smokes it and now since the weather has turned cold they arer both smoking it in the house..shes actually buying it off him anyways i've treid to ask that it not be smoked in the house but my opinion doesnt matter especially when she says he can do what he wants..i have no idea what to do next as i am sick and tired of this...if it was kept outta the house thats fine, i cant control what he decides to do at the age of 19 but its not and will never be..should i call the police?..can i have him removed from the house/property?..the house is in both her and my name.
I just want this to stop in my home!!..this is driving me nuts and i have respitory issues that neither one of them seem to care about |

I take it you are still living in the home? You cannot have the police take him away as he is invited by your ex.
If she is buying it off him then report it as he is trafficking and that may be your way to have him removed. Be prepared for the fallout from your ex though. |

# 1 it's against the law
# 2 if it were my place I would give him an ultimatum smoke outside or "inside" his choice. |

Give them the option of smoking outside or call the police and let them search your home to find their stash. Your house you can invite police in whenever you want

tried giving him that choice but with his mother on his side i get the strong impression that he doesnt care what i have to say, that was why i was asking about having him removed, he just does what he/they want especially about drugs and please understand this is just one small issue in a HUGE problem at this house..i have offered everything to part ways except walk away without a penny, which i just cant do..plus i have a few serious medical issues that i'm trying to deal with at the same time

If you give the ultimatum, follow through, call the cops. I had an issue with this with my ex (not involving the kids). I stated no growing on the property - against the law. He didn't listen, I searched the house and got rid of seeds etc - then informed him in a matter of fact statement that I did. He was pissed, yelled, told me I cost him thousands but the behaviour stopped immediately and he did not bitch to anyone about what I did. Wonder why

usually when police find drugs in a residence all occupants are charged and they leave it to a judge to sort out. even if you make the call there is nothing preventing them from claiming its yours....be ver careful.....
