Default Pension payout and Child Support

Good morning,

If anyone has any specific knowledge of this. If a pension is commuted earl, the portion of the oension which is not transferable to a LIRA etc is paid as taxable income (contributions can be made to RRSPs and TFSA etc).

Does anyone know if thay portion of income for that calendar year is included in the calculation of CS given that the represent a payout of pension contributions?

If you happen to know, please pass it on.

There is an argument that one time payouts are not included. For instance when my partner lost his job the company rrsp contributions were paid out to him through a transfer to his personal rrsp. That was not included in cs calculations. His ex has disputed it verbally but his lawyer said it wouldnt be considered. If it was a normal annual pay out for several years then yes it should be included.

The FCSG state if line 150 is not a true indicator of your income then use either pay slips or a letter from your employer (ie your offer letter).
