Default Medical Insurance for child

I have been paying my CS voluntarily, and ex is on social assistance. We have one child age seven and she is a young woman who refuses to work....which is why she is on social assistance. I make approx. 29-30 grand per year. I do not have medical benefits of any kind with my employment.

My lawyer is trying to expedite my divorce at the next case conference and as my CS is not currently court ordered, she says that this will be something discussed with ex and her lawyer at the next case conference. As mentioned, I currently pay voluntarily as per the support guidelines.

As I do not have any benefits at all with my job, is it likely that I will be forced to pay for my childs medical expenses as well? I can barely afford child support as it is...but I always pay. Anything more than that will leave me homeless.

Thanks
Serrona

serrona,

In Ontario, OHIP covers residents with basic medical coverage. The threshold is that it is free to individuals less than 20K per annum and income beyond that threshold pay a OHIP surtax on their respective income every year.

I realize that you are in another jurisdiction, However, as you mentioned that your ex is receiving social assistance and as such I suspect that your child's medical expenses are being looked after as being a listed dependent.

Over and above medical and dental coverage (extended health benefits) would construe to be a reasonable extra ordinary expense and as such both parents may be expected to contribute to same prorated to reflect their respective income.

In Ontario, social assistance recipients and there dependents receive free prescriptions, dental and eye glass coverage. I do suspect similar coverage is available in your jurisdiction.
