Hello,

I have medical insurance through work that will cover $2500 of my daughter's braces bill. We have joint custody and my ex has primary residency with my daughter. My ex said she will cover the bill herself and refuses to give me the receipts so I can claim it and pay my half. Needless to say, I find this fishy and that I'm going to get screwed down the road. Who wouldn't want $2500 off of a $6000 bill?!?! As the joint custody parent, must the Ortho provide me copies of the receipts if I go directly to them and ask?

You could try contacting the dentist directly. Her medical benefits may cover the whole cost. You could also send her correspondence stating that she has until x date to provide the receipts otherwise you will consider the cost completely covered and will not accept any receipts after that date. (Im not a lawyer though).

My partner is currently going through litigation where his ex is claiming expenses from as far back as 2015 and never told him about them. The lawyer is arguing they are not applicable as she did not seek input or approval and continues to fail to provide documentation. Plus his benefits have a limit of 15 months to submit.

do you need a special clause for this? if you have custody of your child is not assumed you can ask for this info and the organization has to give it to you?

Maybe it is all covered by her insurance. With mine and my ex partners insurance it must go through the parent with the birthday first in the year, and then if anything remaining go through the other parents. I dont think most plans are going to cover 100% orthodintics though, it is does seem suspect that doesnt want to give a bill, unless is just putting it through her own insurance first, and then will let you know what wasnt covered. I agree with the other poster, why not just send an email acknowledging willness to put the cost through your insurance but you must have the bill by such and such a date as you can only claim through insurance by a certain date?

For the most part you are able to request details from anyone providing service to your kid but some ex's put a clause in the medical files saying the other parent cant ask and some places follow that (illegal). You could simply call the doc and tell them you want information and the receipt and if they balk you advise them you will go through the privacy commissioner for medical practitioners. That tends to scare them. If you have the clause in your agreement you can use that first as many places cant argue with it.

Send the email that you want the documentation by x date (take a few weeks off) or you will consider it paid in full and no contribution from you is required. Holding onto receipts is bs and not viewed highly by the court. Theres no reason why she should be doing that.
