Hi everyone, a friend told me about this site so I thought I would join.
Like my name implies, I have sole custody of my daughter, now 13. Gained full custody back in July 2008 altho, have never applied for the cctb. I finally did so, this past November. Last week I found out that her mother has been collecting it. Last check she received was in July 2011. I reported her to CRA and provided them with her name and address etc. CCTB only goes retro 11 months unless you request (in writing) to go beyond 11 months. They don't tell you that upfront. Anyways, my concern was that I would not be entitled to the entire portion of CCTB even though my daughter has been in my custody since 08. Turns out, the rep that I spoke with clearly stated that I would get a lump sum of money going back from day 1 to present. Even if the mother was falsely collecting. He (rep) said they will pay me in full and go after the mom to regain what was paid out to her during that time. I hope the information I was given is accurate. The money sure would help. Considering her mom drained our daughters education fund. Ripped me off by not telling me she lowered monthly payments towards that fund and still gladly accepted my half of the contribution. Was I naive? Oh ya. In my eyes this was for our child to get a jump on rising education costs. Moms eyes, "how can I support my drug habit." I could go on and on . . . lol but I won't. Not sure if this would help anyone but, hope some of it does. If anyone has any feedback on my situation-let me know. Thanks

Welcome Dadw/sole-C. I would expect that CRA is well versed in dealing with these issues. Please update this post to advise if you actually were re-imbursed the full amount. Almost sounds too good to be true. Does your daughter ever see her mom? My ex also was responsible for relieving our son of his RESP. Just for starters. Some people really don't deserve to call themselves "parents."Good Luck

CRA has a form you can complete, or copy of court order with dates will have to be submitted
they went back 3yrs for me, she made 1/4 million plus collected child benefits for children with me while i struggled not able to pay debt dont worry about her, at most she just has to pay it back, had you done ... well thats another storey best of luck to you |

My GF was recently audited for CCTB and let me tell you, the burden of proof to prove that one is entitled to CCTB is very detailed. She had to submit leases, utility bills, day care receipts, letter from child's school and attendance records, and a letter from the family doctor.
If your ex hasn't had the kid full time since 2008, she will have a hard time proving all those CCTB payments. And she will have to pay them back. You will likely experience the same burden of proof; however, if you've had primary custody of the kid full time since 2008, then you'll just need to collect all the supporting evidence and submit it to CRA. Any money your ex owes back to CRA isn't your concern. That's between her and CRA. And her arrears shouldn't have any impact on your eligibility. |

Thanks guys. It most definitely is a burden trying to prove. Oh ya, I've already sent off everything that's required. I'm expecting to hear that what I sent was not enough. Naturally. Why would it go smoothly? I appreciate the feedback.

Just a heads up...my husband was in the same situation with his ex. He filed all the paperwork with Revenue Canada. When the ex was reassessed, she took us back to court, stating we caused the reassessment and now she was "out of pocket" thousands of dollars and we should have to pay it. Well, two years later and numerous lawyer bills, we are still in court. Now she is trying to get spousal support reinstated due to the "income" she lost from Revenue Canada. Good luck and I hope you fair better than we have so far!

My ex collected the CCTB for kids not living with him either. A quick call to Revenue Canada, a few choice words from the ex, apparently it was my fault he had to repay the money, and all was solved. I don't know how far back they go to reimburse but luckily I didn't have to go to court again for his mistakes!
