My wife moved out Sept 1 of last year, I am curious if I am still allowed to claim her and my stepson on my upcoming tax return. She is going to fight me tooth and nail and not sign any forms if I do decided to put them on my tax return.

Go to the CRA website and download the RC-65 form.
You will put the date of separation on the form. You are supposed to file the form at least 90 days after separation (to give you a chance to change your mind I suppose) but they go by the date put on the form. Once you do this, you can claim what you are entitled to for part of the year, and your ex will be able to file her claims. It's a few years ago for me, and I use software that put everything in the right slot for me, so I can't help you further. But you should send that form in asap. |
