Business assets transferred to a trust without spouse's knowledge
In the case of a business owner spouse transferring the assets of business started and grown during marriage, representing 95% of the assets created during marriage, without the knowledge of non owner spouse how does the FLA protect the non owner spouse? The business owner spouse is primacy trustee and beneficiary of the trust and four
children are beneficiaries. Non owning spouse is not included in trust at all. Funds to start business were raised from several sources, inheritance, collateral mortgage on matrimonial home and personal guarantee loan on business owner. No marriage contract has been signed.
