Default My situation

My ex-husband became a deadbeat at birth and held the control thing over me. My lawyer went to court to get an order that I can get a passport w/o his consent to travel on these specific dates since it was an emergency and my ex was being a jerk. I now am able to travel and obtain a passport w/o his consent because he sees the child 3-5% out of the year (if he follows the court order lol) and why should my partner (my son knows him as his dad and he raised him since he was 1 years old) and I ask a stranger to travel with my son? Best option is to ask the courts - if they say no - you are out of luck. Actually, my lawyer told me I would not get what I did because he said why should you be able to travel w/o his permission etc.? I knew I would get it though because it just did not make sense to ask permission and thank god I did.

I am renewing S13's passport. Ex has EOW access. Our custody agreement is "Joint" - but I am "primary caregiver" etc. There is no communication between him and S13 during the intervals between access. I realize I must get Ex's signature etc on passport application. Ex and I do not speak except for a very infrequent text message. This has been the case since the Summer of 2007. So I do not require his "consent" for Travel within Canada, but obviously I do (under our arrangement) for any travel abroad. When does "consent" cease to be required of the other parent? 16? 18?

The child needs to be 18.
