Oh forgot to mention the big other thing - sorry - that he owes backtime for the child support and alimony because although they are taking half of the E.I they are also still docking him for the rest of the amount he owes - no matter what we make... we've tried to ask the court for forgiveness, and for them to count what they have already gotten as payment, but the same judge that he got the idea from to ask for the forgiveness was the same judge the denied him...

was not meaning that as a mean thing, just nevermind that then.

-She got everything in divorce, car, furnature... ect
-He kept the house however sold it once we were married
-She got support and alimony for 2 and a half years - support for children till old enough
-he got visitation every second weekend alternating holidays - as well as a clause that she take care of childcare if needed during the school months and that the children be under my care in the summer months when needed

- We went bankrupt in December - still paying full support
-Moved to new location, but kept up visitation schedual as planned
- She has denied him visitations - only saw the children 44 days out of 2010
-He calls the children every night - when she answers the phone is the children only allowed to speak

- Her Boyfriend/Husband has abused the oldest child, using scare tactics, verbal and mental abuse to try to control him
- CAS closed the case with thought of Bad Parenting - urged the mother and her boyfriend to get parenting help

- Other incidents started with oldest child - Outbursts at school, violence towards teachers, police called for disturbances in household as well as school
-Mother told CAS the children are worried the father is trying to steal them, asks about what the mother does and buys, and is the reason for the children's outbursts

-Father called the Board on CAS for faliure to talk to him about issues, failure to speak to the father about what the children had said about him, and overal ignorance
-After a case conference with the Board and CAS it was determined that they were in the wrong, and they did fail to communicate with the father at any time about any issue. An appology letter was also included, and the case for them and the mother was re-opened

The child has been kicked out of school after the school board and staff have done all they could for the child. The mother had failed to get the right documents and doctors notes required to get him into a special program.
- Father has talked to mother about issues with the son and any plans to fix them. Mother has always hung up the phone or objectified the child instead of working out any issues.
-Both paretns cannot agree on a parenting plan for the child and his needs.

The recordings between the two have been transcribed. Not sure how to introdruce them to court...

We are not making up any lies to the court, nor make any accusations that we do not have evidence to.

We have a private tutor on stand by for the child, resourses availible to us on demand, and perhaps a new life with positive outcomes for him at all times. We are taking parenting classes for Autistic Children, as well as the Triple P Program.

Right now -

We owe child support backtime of over 10,000 because they have been taking half his E.I, but also still charging him for the full amount of over 1,600.
- We had it reduced for 4 months, however was asked to be reasessed after that time
-That is when we had to drop our lawyer because we could not afford it and are getting the financials and information we need for it to get filed.

Letters from the companies involved with us starting our own business with E.I
Letters from his family that have helped us
Letter from Red Cross
Certificates from the courses we took for business

???
We would like forgiveness from our backtime, and the amount lowered to the amount set out in the guidelines as 300 or so a month for her and the children... not forever! Just until we get on our feet again. He has always paid her what she is owed, even before the divorce was finial, she was being paid by cheque before FRO was involved.

I don't see why he has to pay the full amount when he was not recieving the same income as the amount specified before.

- For custody I am still working on the paperwork
- I have some transcriptions in there, also our financials
- We will be asking for temporary custody of the oldest child until a final order is made
-We plan on making a parenting plan for the court to see, including all our parenting classes and agencies we would like to get him involved in. Including any Doctor care he might need - ie: Therapies, Councellers..

I don't know what to say or do about the mother :
she's done so much that I as a mother have a hard time saying because I see it with my own eyes and know that she is in denial of so much. She thinks this is all about her - when in reality is about those poor children she is pulling on.

Please be paitent with me, It's been a year since I've been trying to do this all and I am no lawyer and might not spell, but I do mean this all seriously.
