Hi, I had a question regarding spousal support.
If you are required to pay spousal support to your ex, are you still required to do so if they move in with someone or have someone live with them, in common law relationship - or if they get re married?

Usually there is a cause in the separation agreement that states when a spouse moves in with someone or remarries spousal support payment end. It all depends on the wording of your separation agreement.

[1.] I would think that this would construe to mean a material change of

circumstances and even if there was a separation agreement in force or

court order outlining spousal support, it could be varied. Nothing is final in

family law.

[2.] When a material change of circumstances occurs, the onus is on the

person relying on the material change to prove there is same.
