I am a Canadia Citizen with US Residency (Green Card). I am currently married to a Canadian Citizen who also has a green card. We were married in Canada. If we were to divorce would a US based divorce be recognized in Canada or do we need to go through the process in Canada?

In order for your U.S. divorce to be recognized in Ontario, you would need an opinion letter from an Ontario lawyer recognizing the validity of the divorce. This is otherwise known as a recognition of foreign divorce. You must obtain one of these if you have a foreign divorce and plan on remarrying in Ontario.

Thank you LIndsay. So if I have no plans to get remarried in Ontario then a US based divorce will cover me if I plan to ever remarry in the US?
