REG: termination of support

My daughter has finally contacted me after 8 years of waiting, she has apparently been kicked out of her mothers home and is living with her cousin. She has asked her mother for money but she will not give it to her. We are trying to get the support reversed back to us so that we can help her with that extra money. My question is what forms do I need to fill out?

My understanding is that if you have custody, you get child support. If you want to stop paying, you need to have custody. Your daughter sounds like she's over 14. If she is, depending on the province, she can apply for a change in guardianship as well.

She won;t move here she wants to live in Peterborough and we are in Barrie. Since I have been out of her life for 8 years she isn't going to listen to me now.

She is now living with her cousin so she is no longer with her mother, that is a good reason to terminate support. The money we are giving to support her is not going to her when it should.

If she has removed herself voluntarily from parental control, more than likely no cs is payable by either of you. How old is she?

You can forward a FRO notice of withdrawal to your ex for her to sign and file with FRO. Then, I guess, you can decide if you choose to continue to pay funds to your daughter directly or not.

Do a notice of withdrawal and see if your ex with voluntarily withdraw from FRO.

If not, do a notice to END support through FRO.

If that still doesn't pan out, you file a motion with the court to end support
based on the child living on her own and no longer being a "child of the marriage".

As part of the motion you request for the overpayment of support made to your ex to be returned to you.

This whole process can take weeks or longer, so the sooner you start it, the sooner it happens.
