Chopper is on a distinguished road
Default Need some advise proceeding with divorce

Hello everyone
I used to come on this site regularly in the past but I kinda drifted away and let the lawyers handle it..........what a wrong move!
I have been separated since Dec 1 2005.
At the beginning of separation my ex apparently went balls to the wall applying for divorce, sole custody, spousal support....everything and anything bla bla bla!.......she wanted it done!
So after all this time not one issue has ever been brought to closure, reluctantly the other side always seems to drag things out.
I have since fired my lawyer because after a year and a half I've paid him a fortune and I'm broke with absolutely nothing accomplished....well one thing had been accomplished is that I've lost my home.
Now I'm representing myself, she still has her lawyer.
We have no separation agreement but I do have status quo with my two boys and I see them allot, one night per week overnight and ever second weekend from Friday afternoon until Monday morning.
Can anyone tell me what I can do to proceed with the divorce?
I asked my lawyer last August to get this moving and all wrapped up and I got some excuse from him that we couldn't do any thing because there was a freeze or something because she's the one that applied for the divorce originally.
Can anyone offer me some advise as to what I should do next...I just want to get this done and finalized.
Do I start with a letter to her lawyer that never concludes anything...or can I do something else that will force the issue?
I have come to terms with her leaving and although some hurt remains I am done with this and really want to proceed with my life.

Kind Regards,

CHOPPER

Welcome to Family Law and the wonderful world of Lawyers.
We spent twice what our home was worth in a five - six year span with our lawyer "dragging" things out, then fired his a** and accomplished more in a year self-represented than with him. Anyway, I am not a lawyer nor do I profess to know allot about the FL system or how it works, I do know that on a few occasions we initiated motions and settlement conferences on our own, even though the ex was the one that initiated the divorce proceedings and custody etc.

I think you can file a motion (not sure if this is the proper terminology) in light of the fact that you have status quo as far as visitation goes. My understanding is that a divorce, in and of itself, can be finalized without addressing any other issues provided the other party agrees to the divorce and has no issues with matrimonial property. You can always seek a 1 hour legal consult, or do as we did and pay a fee to have a lawyer review your case and offer an opinion letter. We paid $300 and the letter outlined our various choices, and how to proceed through each choice, along with the lawyer’s professional opinion on the choices.

Not much help was I?
