Default Motion to vary

I have received a motion to vary our separation agreement from my ex.

Can anyone direct me where I might find guidelines for completing my addidavit in response?

Susanna,

A variance is a two stage process.

Generally for a party to be successful in a variance, the onus is on them to first prove a material change of circumstance. Once the material change is proved on the balance of probabilities; the court would proceed to consider the variance.

For information on completing an affidavit, see this historical post on hearsay rules and affidavit writing.

You can download form 14A affidavit (general) here:

I hope this helps
