I have received a motion to vary our separation agreement from my ex.
Can anyone direct me where I might find guidelines for completing my addidavit in response? |

A variance is a two stage process. Generally for a party to be successful in a variance, the onus is on them to first prove a material change of circumstance. Once the material change is proved on the balance of probabilities; the court would proceed to consider the variance.
