Default married to US citizen

hello, I am married to a American citizen, we where living in Germany on orders because he was serving in the Army. I came back to canada about 5 years ago and am now seeking information on a divorce. he currently is back in the united states.
basicly my question is, since we married here in ontario and he lives abroad is there any special forms or things i need to do to get an uncontested divorce?

Hi nicole613,

No, there isn't anything special you must do. The fact that you were married in Ontario is irrelevant. A party's ability to obtain a divorce in Ontario is instead based on residency (at least one party is required to be normally resident in the province for at least one year).

Since your husband is now in the U.S., your uncontested divorce will be no different than if both of you were living in Ontario. Residents of North America still only have 30 days to respond to an application (or to be noted in default). It is the respondents living outside of North America who have 60 days to respond (or be noted in default).
