Would there be any circumstance where a lawyer would advise an NCP to not pay child support to the CP and put it in a savings account instead?

Would a lawyer recommend an NCP doing that even temporarily?

1. If there was no order for c/s and the custody arrangement hasn't otherwise been agreed to (ie - one parent wants a shared schedule, the other wants the EOW screwjob, but no order/agreement specifying has been established).

2. If there was question over whether the child is still a child of marriage (ie - the child quit school after becoming 18, but may go back to school, but may not).

Those are two scenarios I could think of off the top of my head. Especially number 2, as the child isn't a child of marriage.......for the time being.... And while the child may go back to school, and retro c/s could be ordered in those circumstances, there is no guarantee that the child will.

Thanks HammerDad.

There's no court order and previous access schedule is "flexible, reasonable access based on dad's availability"

However, with one parent out of town, full CS will be paid no matter what the access schedule comes out to.

I didn't think a lawyer would recommend withholding payment for that reason.

Both children are nowhere near college/university
