Judge's CC endorsement & non-compliance
At a CC we came to an agreement on a number for equalization payment. Judge endorsed it and I received a photocopy of the hand written order. Went to the bank, but unfortunately cannot get the mortgage financing to meet the order. Main reasons are:
1) Do not have tax assessment for this year where income is about 15% higher than previous two years and would work better
2) Was re-assessed last year and handed a bill to pay almost $4,000 more in taxes because ex refuses to author a letter with our signatures on it stating to the CRA that we are shared custody for the past two years since marriage over. Now my credit rating is marked by this back-tax order.
3) Bank very nervous about there being no written agreement or court order regarding child support, which I have been paying above the set-off method, which I think I am entitled to pay only, based on custody arrangement.
Next scheduled court date is for a TMC about three month away. I'd like to get things resolved without going to trial, but I have all the evidence I need to prove pretty much everything in my case. I have an order I cannot comply with and mostly because the other party has caused the problem for me.
What should I do now to get them back to the table to negotiate?
