The courthouse faxed us a "Request for Conference/Motion Date" form to set a trial date.
We are a little confused by the process... - Do both parties fill out their separate form and fax it in? - The Application and Answer (Fast Track or Standard Track) - is that a NEW Application and Answer or the one from the original motion? - What happens if some of the issues were settled, how are those noted and how is the court notified of this? Any advice on filling out this form is greatly appreciated. Thanks! Also, we've never had a trial so we don't know what the next step is. My husband and I plan on going to talk to someone at FLIC, but with me working full time and him focused on finding a job and searching full time, it's hard to find the time. If anyone who has, sadly, gone through the process could lend some helpful suggestions, we'd greatly appreciate it. Thanks. Last edited by #1StepMom; 09-22-2009 at 07:29 AM. |

Frustrated, I finally got through to the Trial Co-ordinator's Office. All you need is to fax in the Request for Conference/Motion Date form, on which you indicate who the parties are, their respective lawyers, the dates when the original Application and Answer were served, and the requested trial dates. (You can ask them for available time frames, from which you will be able to choose your top 3 choices.)
Basically, the only concern that the trial co-ordinator has is whether or not there has been a case and settlement conference - which they will know by the date of the initial Application and Answer. Supposedly a lot of people attempt to set up a trial without going through the motions of conferences. As for what forms to file to indicate issues that have been resolved... I'm guessing Form 15C - Consent to Change Final Order - but I'm not sure. Still working on obtaining that info. Will do some more reading this weekend. :-) |

our paperwork says to file a supplimentary affidavit to include more information, also, I guess we'll also be doing a new financial statement, says to be filed 3 business days before. I am wondering if there is anything else
