Default Good day in court! Things almost finalized.

Finally had a good day in court.

After almost 2 years of adjournments and such I got an order for some child support. I have to amend my initial filing to ask for back support but for now they are imputing income. Not that I hold out much hope that I will see any support any time soon but at least it is in the works hopefully!

As for the other Child protection matter, we are only steps away from it being finalized and over. The next court appearance is asking for summary judgement with me having sole (which I have right now on a temporary order) and mom to have supervised access.

I am a little overwhelmed because i have never done a summary motion. All the lawyers said that it will be me being the moving party, and CAS will write a response supporting my motion, and the OCL is in support of this plan.

Don't want to hope too much but it is possible that in less then 3 months my last 12 years of litigation might finally come to a permanent end!

For those who have not followed my posts I went from an access parent who was not even on birth certificate, and very minimal access to sole custody! It has taken 12 years and a lot of baby steps to get here.

Congrats!! Your daughter has been through the wringer and hopefully this helps build the stability you have been providing!!!

Ugh, the CAS should be the moving party under the Family Services Act. I recommend you review some of the summary judgment materials in CanLII that CAS has done. Generally the only time a summary judgment is done is if CAS is involved. So you have a higher probability of success.

You may want to get some assistance from FLIC and duty counsel. If you can hire a lawyer that is always the best. Summary judgements are not easy. They are technically hard things to do.
