our first appearance is fast approaching......I am nervous as hell.......I hope to God his mother doesnt show (her nose is in others business all the time) ...I just would like to know if a judge would tell my ex that he is responsible for half of the back daycare expenses

Littleman,

You can't really control who shows up for the court. It is open to the public.


In regards to daycare expenses, I believe the court would order retro proportionate share on these expenses.

Littleman,

You mentioned "first appearance." Has all the documents been served and filed by both parties such as application, answer and reply, conference brief, and financial statements?

If all documents have been served and filed, you will perhaps meet with a registrar, the registrar will confirm that the documents have been served and filed into the record. The Registar will confirm the issues. If everything is good, you will perhaps have your first case conference that afternoon.

A case conference is held in front of the Judge. The Judge may express his view but is generally for procedural issues such as having a parental assessment or having the office of the children's lawyer involved. A judge may give an opinion or may set a date for interim motion or further case conference.
