Relocation case with joint custody, mother was able to move and got almost full cost award. It is a different story, but interesting to read.
Just know that each case turns into it's own facts. No two family law cases are the same. Just because something happened in someones case doesn't mean that the same exact thing will happen to you. For every case law you find to support your position, he will find five to debut yours and support his position.

A) the parents in this case had joint custody, you oppose joint custody.

B) an OCL assessment was ordered, you oppose an OCL assessment.

C) the father brought forth the motion but then didntfollow through, you have stated your ex has deep pockets and will fight with every dime he has.

You better dig deeper. Your case is nothing like this one.

Canlii is a lovely resource, but what the great minds of this site taught me is that the caselaw you want to rely on must very closely resemble your situation

For every 10 canlii cases you post here where one parent was granted mobility, I can find 10 where they were denied. But I know how you feel, they used to get me all excited too.

Have you told your child that he may need to start saying good bye to his good friends, relatives, sportsteams, teachers, etc so that you can get that visa with your new guy in a new country?

I hope you remember that you already agreed to a mobility claus inhibiting you from relocating with the child. Not sure how you'll handle that one.
