Default Child Support Issue

My wife and I are recently separated. We have 2 children. One of the children isn't mine biologically. We have been married for almost 6 years and lived together for about 6 and a half years. She has made attempts to go after the father of her first child for child support. Didn't follow through.

Will I be responsible for the financial support of this child? I know that this has no legal bearing but she has thrown away the marriage. I gave her chance after chance. She has cheated on me on numerous occasions. Even "dated" someone for months while we were together.

Any help would be appreciated. Thanks.

It would seem that you acted "in loco parentis", meaning basically that you acted as the child's parent, and so you would be responsible for child support. That being said, I would definately add the bio dad to the proceedings as he has a primary obligation to pay. He would likely pay full CS and you would pay some portional amount. Obviously, for the child which is biologically yours, you're on the hook for the full amount.

Actually, we don't know if you acted 'in loco parentis'. Did you treat the child as your own? Did he/she call you dad? Did you have the same care for and responsibilities for the child as your own?

If you want visitation rights to the non-bio kid, you'll likely have to pay CS regardless.
