Default Can she move to the U.S. with her kids?

Here's my problem. I am in love with a Canadian woman who is not married, but is living with someone. They have a kid together, and she has one from a previous marriage. The kids are 12 and 7. She has no intentions of marrying the guy she is currently living with and wants desperately to come live with me, but she said Canadian law will not allow her to move the kids to the U.S. Is this true? She said her boyfriend is a terrible father to the kids, but I doubt there is any abuse at all. Most likely, he just doesnt care. Can we do anything about this situation.

She will need consent from the fathers of both children to move.

Does your girlfriend have a court order or agreement with this chap regarding the support or custody of her children?

She gets support from her ex-husband for the oldest child. The boyfriend is the father of the 7 yr old and lives with them. He does pay child support for another child from a previous marriage though.

USAguy,

Sk8r is right. Unfortunately, your girlfriend must obtain permission or consent from each child's father before moving anywhere.

I think a good start would be for her to speak with each child's father and let them know what the situation is. Hopefully, if she is on good terms with both of them, they can all work something out.

I appreciate all of the replies. I know it's a long road, and neither guy is likely to give permission for the move, so we'll have to figure something else out.
