Default adult child in school part time

im in a middle of divorce and my daughter is 25 and is registered part time in university,ex is asking for spousal support and child support ,adult child is 25 and will live with ex,child is not working,anyone could help me to find out if the child qualifies for support or any support? for school etc

Do you have an existing court order or separation agreement?

If you had mine, you would not have to pay CS for your child for a number of reasons. One is that we have a terminating event set at the age of 22, or reaching their first degree/diploma. The second is that your child is not a full time student (the definition of which depends on the school).

But the basic guidelines are: full time student.

Lol.... Really?
The child(?) is an adult now.
If they choose to live at Mommys and attend part time school, that is an adult decision.
No CS should be paid.

“child of the marriage” means a child of two spouses or former spouses who, at the material time,

(a) is under the age of majority and who has not withdrawn from their charge, or

(b) is the age of majority or over and under their charge but unable, by reason of illness, disability or other cause, to withdraw from their charge or to obtain the necessaries of life;
Generally, to be unable to obtain the necessaries of life by reason of post secondary education the child must be in school full time.

Why are they not in full time education, or otherwise working?
