OK common law situation under 4 years I bought a house before I met her she moved in I payed everything but groceries, she payed for her car and insurance. We spit up up officially at the end of august. we had an agreement we both signed not witnessed or notorized, basically I would help her for up to 3 years with school and such or until she was able to get on her feet, she was to pay me rent every month, if she decided to leave she would take my old car and some other things. she never paid the rent I gave her money for school

A few days after we broke up I woke up with her at the end of the bed talking about suicide and how I should feel guilty, I recorded it. She called my father at 3am harassing him, when she was looking for an apartment she wanted my parents company to write a letter saying she was working for them so she could get the apartment. I recorded it

She meets new man a couple weeks after we broke up now she wants to move in with him they are getting an apartment on Nov 1st, I sign the car over to her ..the next day she goes to court and gets an Exclusive Possession order, I haven't been served yet.

What do I do .. we have no kids she lost her job because she was chasing this guy around and she was on 3 month probation at work so they canned her. also does any one know a good lawyer in London Ont.?

how can I stay in my house.? how long after I have to leave will it take for me to get back in.? and how do I get her out of my life?

More info we have no kids, no joint bank accounts, the mortgage is all in my name , I also noticed she's selling jewelery I gave her and she gave back to me on Kijiji

She got, or wants, an exclusive possession order on your home? And you haven't been served yet?

Unless the circumstances are very extreme I fail to see how she could be granted exclusive possession of the home and you even didn't get to appear in court.

Please clarify in plain (non abbreviated point form type) language what really happened.

did she tell you that she filed for exclusive possession?? If so remember her state of mind, she wanted your father to lie so she could get a place, the talking of suicide etc. She could be lying about it to try and get more out of it. If she is moving in with the new guy into an apartment then why does she need your house? Do not leave your house unless court ordered. She is/has been playing you for a sucker and wants to see what else she can get out of you.

One of her Friends told me " she went to the court house to get exclusive rites to the house until she moves" I'm guessing that means she went to the family law center and said I was abusing her " typical" she has no proof because nothing ever happened. I'm assuming her friend means exclusive possesion order

I'm new to all this but can she go to court get an order and have me served and the police escort me out without be able to defend against her accusations, when I'm the sole owner of the house.? what I'm asking basicly what the process is..I know I'm not great at explaining but I'm in sort of a panic..thanks for the reply though

I think they would have a difficult time with an exclusive possession order considering there are no children, the relationship was short and common law. I'm with Sots, I think she is playing you like a Wii.

so she can't just go to court and say I abuse her and they kick me out without having a say or chance to defend myself.. all her things are packed by the front door in boxes she is barley here during the week, when she is I stay in my room her in hers. I'm just waiting this out ..or should I be doing something.?

Change the locks once they are out.

I would protect myself by ensuring that you have witnesses anytime you are near her, or at the very least have a recorder going anytime she comes near you.

Change your locks, and if she comes by, go someplace else. Do not talk with her.

It is possible for her to get an exclusive possession order if she says the right things, and the judge believes her. It is possible that you can have your who day ruined by such an order.
