Yes, but title insurance does not protect a bank in the event of a default on the mortgage. It is for identity fraud and errors that may have been made on transfer of title I believe.

What I meant was, the banks don't check the titles properly and people can put whatever they want on their applications. Sometimes it is fraud, sometimes it is an honest mistake, but the application goes through anyway.
