Since June of 1978, I have been specializing in family law in and around the Los Angeles area. I conduct private mediation, as well as volunteer mediation for the Los Angeles Superior Court. In addition, I served as a Judge Pro Tempore for the family law courts of the Los Angeles Superior Court.
As the chairman of the Family Law Section executive Committee, I am a respected and active member of the San Fernando Valley Bar Association. Many people who are exploring the option of divorce have little to no knowledge about the dissolution process. The legal proceedings can be difficult and confusing, so I have developed an initial consultation which otherwise is considered a "teaching consultation." This consultation is for potential clients including those who are just "thinking" about a divorce and want to "know their rights." Even those who have had legal counsel, are sometimes uninformed by their lawyer about many parts of the dissolution process and they have found my consultation to be extremely helpful and informative. With a number of charts and schedules that I developed over the years, we will review and discuss, among other issues and your questions, the following:
The court process from the beginning of the process (filing), including where, when, and in what court to file the action (dissolution of marriage (i.e. divorce), legal separation, or annulment), through trial, and later modification(s).
Property schedules regarding what is community and separate property, assets and debts, how are they divided, and what is "the date of separation" for property purposes.
Spousal support (known as "alimony" on the Federal level) including temporary and long term (or Judgment support), short marriage (generally less than 10 years) and rules regarding receiving support for "one-half the length of the marriage."
Issues regarding the child or children, including physical custody, legal custody (should it be "joint" "sole" "monitored/supervised" ) time-sharing/parenting plans/visitation, as well as the amount of child support including calculations with the computerized Statewide Uniform Guideline. These issue would also be applicable regarding a paternity action.
Attorney fees payable by your spouse based on "need and"ability to pay" as well as a sanction (or penalty) based upon "conduct."
Your potential attorney fees, costs (court filing fees, expert witness expenses such as appraisers, and accountants), retainer fees, and hourly rates.
The Standard Family Law Restraining Orders [removal of the child(ren) from California, insurance and property issues)].
Domestic Violence restraining orders.
Negotiation techniques and strategy and keys to getting the matter revolved.
Alternatives to the legal process: Mediation; Arbitration; utilizing the services of a retired Family Law Judge.
