A part of most contested family law proceedings, alternative dispute resolution takes many forms; the most common forms utilized are arbitration and mediation. Arbitration is a proceeding in which the parties agree upon an individual who will hear the cases of both parties and render a binding award. Mediation is more popular in family law, and many judges require parties to mediate their cases. In mediation, the mediator has no authority to bind the parties to any settlement, but rather, facilitates settlement negotiations between the parties so that they can reach a voluntary settlement of their own.
